Specifics of the shoot:
Date(s) and time(s) of the shoot must be requested 2 weeks minimum prior to signing contracts
Location(s) of shoots must be agreed upon 48 hours before the photoshoot is scheduled
Number of hours of coverage: (1 hour minimum, 8 hour MAX) any hours worked over 5 hours will result in a 30 minute break at the 5 hour mark. If asked to shoot more hours than originally agreed on, clients will need to pay an extra $50 fee per hour.
Any specific shot lists or creative requests must be discussed prior to photoshoot. Any last minute requests will be accommodated to the best of the photographers ability. Certain requests may be denied with a reason provided
Number of photographers/assistants. (1 minimum photographer) for large events and certain portraits will require a photographer's assistant. Prices for an assistant are based on event, size, and availability.
Deliverables:
Final edited images received will be 5 minimum. Maximum will be dependent on the type(s) of photoshoot(s).
Images can be provided in the following formats: high-resolution JPEGs, prints, albums. (RAW Photos will not be provided unless agreed upon before service)
Photos will be delivered via online gallery OR USB drive, prints or posters at an extra cost.
5 "sneak peak" photos will be delivered within 24 hours of the end of the photoshoot. All final photos will be delivered via online gallery in 7 days from the photoshoot. Photos ordered via print, USB, Poster will take up to 3 weeks
Post-production/Editing:
Standard editing includes: color correction, light retouching
Extensive retouching or specific editing requests will be an additional charge discussed prior to editing photos
This statement is to confirm that Susanna's Photography (Susanna: the photographer), retains full creative control and artistic license over the photographic images created during our session
This includes, but is not limited to, decisions regarding:
Image Selection: The final choice of images presented to the client.
Editing Style: Color correction, cropping, retouching, stylistic enhancements, and any other post-processing techniques applied.
Artistic Vision: The overall aesthetic, mood, and storytelling conveyed through the photographs.
3. Payment Details:
Total cost of services will be discussed prior to the scheduled photoshoot, any additional costs discussed thereafter; will be billed accordingly. If payment is not received the photographer is not liable for photo release on discussed dates and times
Payment schedule:
$75 deposit is required before portrait, graduation, car shoots. $100 Deposit is required prior to couples, family, engagement and product. $250 deposit is required before wedding, commercial, and event(s) shoots
Deposit must be made upon signing contract(s)
Any payment required after a deposit must be made 24 hours prior to photoshoot.
Accepted payment methods: Venmo, Cash, Card (additional charges may apply), or counter checks.
Late payment policy:
Penalties for non-payment will result in cancelation of photoshoot with no refund, or photos not being shared
Additional fees/expenses:
Travel expenses: mileage, accommodation, flights will be discussed prior to photoshoots. Any photoshoot over 25 miles via car will have additional cost of $0.75 per mile. Flights and additional accommodations i.e. hotels or lodging, meals, rentals will be booked beforehand and discussed with the client.
Permit fees for locations will be discussed and agreed upon prior to photoshoot
Costs for additional prints, albums, or products will be billed after photos are edited and prints are requested
Client(s) have 4 weeks after the photoshoot to request for prints, albums, and products
Rescheduling fees will be given if a client reschedules less than 48 hours before photoshoot
4. Copyright and Usage Rights:
Copyright ownership: The photographer retains copyright to all images.
Client usage rights:
Client(s) can use the images for personal use, social media with credit, internal business use, advertising will have additional cost
Client(s) cannot use the images to sell them, alter them without permission
Attribution/credit are required when images are published online
Photographer's usage rights:
Permission for the photographer to use images for portfolio, marketing, social media, competitions, and self-promotion is granted at signing of contracts unless otherwise discussed
5. Cancellation, Rescheduling, and Refunds:
Client cancellation policy:
48 cancellation policy is required prior to photoshoot
A partial refund will be made if the client(s) cancel within the 48 hour period. Refunds will be made within 7 business days
Photographer cancellation policy:
If the photographer is unable to perform services illness, emergency, force majeure refunds will be made complete.
Recommendations for a different photographer will be attempted or rescheduling will be made at half price.
6. Liability Limitations and Indemnification:
Protection for the photographer: If photos are lost, stolen, or damaged due to circumstances beyond the photographers control (e.i, equipment malfunction, natural disaster, etc.). a photoshoot will be rescheduled at 25% of original price. (Subject to change per photoshoot type)
Limitation of liability: Liability is limited to the amount paid by the client for the services
Client responsibility: Obtaining permits, ensuring safety at the location, providing a meal if applicable, etc.
Indemnification: Client(s) agrees to hold the photographer harmless from any claims, damages, or costs arising from the client's use of the images or actions during the shoot.
7. Releases and Waivers:
Model Release: If the client (or anyone in the photos) is identifiable and photographer intends to use the images for marketing or commercial purposes. Clients must sign a waiver before the photoshoot stating they allow or disallow for photos to be used for marketing or commercial use
Property Release: If shooting on private property that isn't publicly accessible, a property owner's release might be necessary.
Waiver of Liability: a waiver must be signed and acknowledged before photoshoots.
Sample of Waiver: I, [Releasor's Full Name], acknowledge that I am voluntarily participating in a photography session with Susanna of Susanna's Photography, which may include activities such as posing, moving around different locations, and interacting with props or equipment. I understand that participating in any activity carries inherent risks, including but not limited to, the possibility of personal injury, damage to my property, or other unforeseen harm. I hereby release and discharge Susanna of Susanna's Photography, its employees, agents, and representatives, from any and all claims, demands, losses, damages, and liabilities of any kind, whether known or unknown, arising from or related to my participation in this photography session. I further agree to indemnify and hold harmless Susanna of Susanna's Photography from any claims, actions, damages, costs, or expenses, including attorney's fees, that may arise from my participation. I confirm that I have read this waiver, understand its terms, and agree to be bound by them voluntarily and without coercion.
8. Communication and Conduct:
Communication will be made VIA email or text
Expectations for client conduct during the shoot will not be limited to professionalism, collaboration, respect, etc.
If other photographers are hired for photoshoots, names and contact information must be provided in a timely manner to the photographer (Susanna) from client(s). Wedding photoshoots will not permit guests taking photos at any given time during private or specially requested photos. It is the Client(s) responsibility to discuss expectations with guests prior to Wedding or Events
9. Governing Law and Dispute Resolution:
How disputes will be resolved: mediation, arbitration, small claims court
10. Entire Agreement Clause:
Written contract constitutes the entire agreement between the parties, superseding any prior discussions or agreements.
11. Severability Clause:
If any part of the contract is found to be unenforceable, the rest of the contract remains valid.
